TERMS & CONDITIONS (TERMS OF USE)

This document is an electronic record under the Information Technology Act, 2000 and the rules made thereunder, as well as amended provisions relating to electronic records in various statutes, as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, requiring publication of the rules, regulations, privacy policy and Terms of Use for access or usage of the domain name landandplot.com (the “Website”) and the related mobile site(s) and mobile application(s) (collectively, the “Platform”).

The Platform is owned and operated by LUMPSUMIFY PVT LTD, a company incorporated under the Companies Act, 2013, with its registered office at Flat 1D, Jain Silpa Cyber View, Gachibowli, Hyderabad, Telangana, 500032 (hereinafter referred to as the “Platform Owner”, “we”, “us”, “our”).

Your use of the Platform, its services, tools and features (collectively, the “Services”) is governed by these Terms & Conditions (“Terms of Use”), along with the applicable policies (including but not limited to the Privacy Policy and Cancellation & Refund Policy) which are incorporated herein by reference. By using or transacting on the Platform, you contract with the Platform Owner, and these Terms of Use constitute your binding obligations.

Any terms proposed by you that are additional to or conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. We may modify these Terms of Use at any time without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates.

For the purposes of these Terms of Use, wherever the context so requires, “you”, “your” or “User” shall mean any natural or legal person who has agreed to become a user/buyer/seller/agent on the Platform and/or who accesses or uses the Platform in any manner.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE. PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.

1. About the Platform & User Roles

  1. Users (Buyers/Sellers): Individuals or entities who browse property listings, post properties for sale/rent, or express interest in listed properties. Users see a feed of listings curated by their search/filter selections.
  2. Agents (Brokers): Individuals or entities who assist in marketing/brokering properties. Agents may be assigned specific properties to broker via the Platform.
  3. Intermediary Role: The Platform functions as a technology intermediary enabling interactions between Users and Agents. Unless expressly stated, the Platform Owner does not own, sell, or control any properties listed and is not a party to any sale/rent agreement between Users and Agents.

2. Eligibility & Account Registration

  1. You must be competent to contract under the Indian Contract Act, 1872 (at least 18 years old and of sound mind). If you register on behalf of a business entity, you represent that you have authority to bind that entity.
  2. You agree to provide true, accurate and complete information during registration and to maintain and promptly update such information. You are responsible for all acts under your account and for safeguarding your login credentials/OTP.

3. Your Undertakings & Obligations

  1. You shall use the Platform and Services in compliance with these Terms and all applicable laws, regulations and guidelines.
  2. You agree not to:
    • Use the Platform for any unlawful, illegal or prohibited purpose.
    • Post false, misleading or fraudulent listings or information.
    • Infringe any intellectual property or proprietary rights of the Platform Owner or any third party.
    • Reverse engineer, decompile or otherwise attempt to extract source code from the Platform.
    • Introduce viruses, trojans, or any malicious code.
  3. You agree to pay all applicable charges/fees for paid Services (see Section 7).
  4. Unauthorized use of the Platform/Services may lead to action under these Terms and/or applicable law.

4. Platform Content & Intellectual Property

  1. The Platform’s content—including design, layout, graphics, logos, trademarks, and software—is proprietary to or licensed by the Platform Owner. You shall not claim any rights, title or interest in such content.
  2. User-generated content (e.g., property photos, descriptions) remains your responsibility. By uploading/posting, you grant the Platform Owner a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content to operate and promote the Platform.

5. Information, Warranties & Disclaimers

  1. We and third parties provide information/materials on the Platform “as is”. We make no warranty or guarantee regarding accuracy, timeliness, performance, completeness, or suitability for any purpose. You acknowledge such information may contain errors and we expressly exclude liability for those to the fullest extent permitted by law.
  2. Your use of the Platform/Services is at your own risk and discretion. You must independently assess that any property or service meets your requirements.
  3. The Platform may contain links to third-party websites/services provided for convenience. Upon accessing these links, you will be governed by their terms and policies. We do not control or endorse, and are not responsible for, third-party content/services.

6. Transactions & Contract Formation

  1. By initiating any transaction (e.g., posting a property, engaging an Agent, expressing interest), you acknowledge you are entering into a legally binding contract with the relevant party (User/Agent/Platform Owner, as applicable).
  2. Unless expressly stated, the Platform Owner is not responsible for fulfillment, quality, legality, title or any other aspect of properties listed or brokered on the Platform.

7. Fees & Payments

  1. The only paid service currently offered is posting a listing. Applicable fees will be shown on the Platform before you pay.
  2. Payments are processed via third-party gateways (e.g., PhonePe). We do not store full card/payment data on our servers. All payments are subject to the payment gateway’s terms.

9. Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates and their officers, directors, agents, and employees from any claims, demands, actions, penalties (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms, Privacy Policy or other policies; (b) violation of any law or third-party rights; or (c) misuse of the Platform/Services.

10. Limitation of Liability

In no event shall the Platform Owner be liable for indirect, consequential, incidental, special or punitive damages, including loss of profits, revenue, data, business opportunities or other economic losses, whether in contract, tort (including negligence), warranty or otherwise.

Total aggregate liability for any claim arising from your use of the Services shall not exceed the amount you paid for the Service giving rise to the claim or Rupees One Hundred (Rs. 100), whichever is less.

11. Force Majeure

Neither party is liable for failure to perform obligations if prevented or delayed by a force majeure event, including acts of God, fire, flood, war, riots, epidemics/pandemics, government actions, internet failures or other events beyond reasonable control.

12. Governing Law & Jurisdiction

These Terms and any dispute shall be governed by the laws of India. Courts in Hyderabad, Telangana shall have exclusive jurisdiction.

13. Miscellaneous

  1. Severability: If any provision is held invalid, the remaining provisions remain in full force.
  2. No Waiver: No waiver by us of any term shall be deemed a continuing waiver.
  3. Assignment: You may not assign rights/obligations without our prior written consent. We may assign without restriction.
  4. Notices: All communications relating to these Terms must be sent to admin@landandplot.com.
